No. 4624. AGREEMENT[1] BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF THE FEDERAL REPUBLIC OF GERMANY CONCERNING THE AUTHORIZATION TO PERFORM ACTS OF CIVIL REGISTRATION. SIGNED AT TOKYO, ON 27 JUNE 1957

The Government of Japan and the Government of the Federal Republic of Germany have concluded the following Agreement:

Article 1

(1) Diplomatic representatives and consuls of the Contracting States shall be entitled to record marriages between betrothed persons who are nationals of the sending State, provided that they are empowered to do so under the regulations of the sending State.

(2) Marriages concluded in accordance with paragraph (1) above shall be notified immediately to the Ministry of Foreign Affairs of the receiving State through the diplomatic representative of the sending State.

Article 2

(1) Diplomatic representatives and consuls of the Contracting States shall be entitled to register births and deaths of nationals of the sending State in the form prescribed by the law of that State.

(2) The obligations imposed by the law of the receiving State with regard to the notification of births and deaths shall not be affected by the provisions of this article.

Article 3

This Agreement shall also be valid in the Land of Berlin, unless the Government of the Federal Republic of Germany informs the Government of Japan to the contrary within three months of the entry into force of the Agreement.

Article 4

(1) This Agreement shall enter into force on the date of its signature.

(2) This Agreement shall cease to have effect three months after the date on which one of the two Governments notifies the other Government that it wishes to terminate it.

(3) Article 1 shall cease to have effect if provision should be made in the domestic legislation of one of the Contracting States that marriages may be concluded only before the competent local authorities.

In witness whereof the plenipotentiaries have signed this Agreement.
