4615. EXCHANGE OF NOTES CONSTITUTING AN AGREEMENT[1] BETWEEN THE GOVERNMENT OF JAPAN AND THE GOVERNMENT OF SPAIN REGARDING THE SETTLEMENT OF THE PROBLEM CONCERNING CERTAIN TYPES OF SPANISH CLAIMS. MADRID, 8 JANUARY 1957

Monsieur le Ministre,

With reference to our recent conversations regarding the settlement of the problem concerning certain types of Spanish claims, I have the honour to inform Your Excellency that the Government of Japan proposes that the two Governments agree upon the following arrangements:

  1. For the purpose of satisfying the claims for reparation of the damage and sufferings caused during the Second World War by agencies of the Government of Japan upon the Government of Spain and Spanish nationals and for which the Government of Japan is held responsible under the rules of international law, the Government of Japan will pay to the Government of Spain the amount equivalent to five million five hundred thousand United States dollars.
  2. The payment referred to in the preceding paragraph will be made by the end of March, 1957, with the United States dollars or Pounds sterling at the option of the Government of Japan.
  3. Payment of the amount mentioned in paragraph 1 above fully and finally discharges the Government of Japan from all liability in respect of all the claims for reparation of the damage and sufferings mentioned in the said paragraph.

I have further the honour to propose that this Note and Your Excellency's reply confirming the acceptance by your Government of the above proposal shall be regarded as constituting an agreement between the two Governments which enters into effect on the date of Your Excellency's Note of reply.

I avail myself of this opportunity to renew to Your Excellency, Monsieur le Ministre, the assurance of my highest consideration.

I have the honour to acknowledge the receipt of Your Excellency's Note dated January 8th, 1957, which reads as follows:

I have further the honour to inform Your Excellency that the Government of Spain accepts the proposal of the Government of Japan embodied in the Note under acknowledgement and to confirm that the Note and this reply are considered as constituting an agreement between the two Governments which enters into effect on this date.

I avail myself of this opportunity to renew to Your Excellency, Monsieur l'Ambassadeur, the assurance of my high consideration.
