EXCHANGE OF NOTES BETWEEN GREAT BRITAIN AND NORTHERN IRELAND AND TURKEY REGARDING THE SETTLEMENT OF CLAIMS AGAINST THE TURKISH GOVERNMENT IN RESPECT OF OUTSTANDING JUDGMENTS PRONOUNCED BY THE ANGLO-TURKISH MIXED ARBITRAL TRIBUNAL CONSTITUTED IN VIRTUE OF PART 3, SECTION 5, OF THE TREATY OF LAUSANNE, TOGETHER WITH NOTES EXCHANGED REGARDING THE EXCLUSION FROM THIS ARRANGEMENT OF THE JUDGMENT GIVEN IN FAVOUR OF MESSRS. GILCHRIST WALKER AND COMPANY. ANKARA, 23 MARCH, 1944.

Your Excellency,

As you are aware, discussions have taken place between your Embassy and this Ministry on the arrangement for liquidating the unexecuted judgments of the Anglo-Turkish Mixed Arbitral Tribunal and it was orally agreed that a total sum of £T 107,100 should be paid by the Government of the Republic to the Government of His Britannic Majesty in ten annual instalments, without interests, in full and final settlement of the judgments in question.

I have the honour to inform Your Excellency that my Government has approved the above-mentioned arrangement as follows:

1. The total sum of £T 107,100 shall be paid direct to the Government of His Britannic Majesty in ten annual instalments, without interest, of £T 10,710 each which the Turkish Treasury will disburse at the beginning of each financial year and which will not be liable to any deductions in respect of duties, taxes or other charges.

2. The payment of the afore-mentioned total sum shall release the Turkish Government from all liability in respect of the claims of the British Government or of British subjects in connexion with all awards made by the Anglo-Turkish Mixed Arbitral Tribunal, relating both to pecuniary claims and movable assets and to immovable assets, and including, without any exception, awards made

​enforceable but not hitherto fully or partially executed, awards made non-enforceable and awards which have not been reviewed, because no application therefor was made by the parties concerned. It is understood that awards which have been enforced are not included in this arrangement.

The necessary Instructions will be given to the relevant Department to have payment effected as soon as your Embassy confirms the above by a letter of acknowledgment, as has also been agreed. I have the honour to be, etc.

I have the honour to acknowledge receipt of Your Excellency's letter of today's date confirming the oral arrangement between us whereby the Turkish Government undertake to pay to His Majesty's Government in the United Kingdom in ten annual instalments and without interest, the sum of £T. 107,100 in full liquidation of unexecuted judgments of the Anglo-Turkish Mixed Arbitral Tribunal.

2. By direction of my Government I have the honour to confirm to Your Excellency their acceptance of this arrangement the terms of which are stated in Your Excellency's letter as follows:—

3. I take note that on receipt of this letter Your Excellency will take steps to ensure that the competent Turkish authorities will receive the necessary instructions to effect payment in accordance with the arrangement.

Further to my letter of today's date regarding the final settlement of un-executed awards of the Anglo-Turkish Mixed Arbitral Tribunal, I have the honour to inform Your Excellency that the award in favour of Gilchrist, Walker and Company is not included in this arrangement.

I have the honour to acknowledge receipt of Your Excellency's letter of to-day's date in which you state that the judgment given by the Anglo-Turkish Mixed Arbitral Tribunal in favour of Messrs. Gilchrist, Walker and Company is excluded from the arrangement which we have concluded to-day regarding the general liquidation of unexecuted judgments of the Anglo-Turkish Mixed Arbitral Tribunal.
