ORDER OF THE LORD CHANCELLOR AS TO THE JURISDICTION OF COUNTY COURTS UNDER THE COMPANIES (WINDING-UP) ACT, 1890.[1]

I, the Right Honourable Hardinge Stanley, Baron Halsbury, Lord High Chancellor of Great Britain, do hereby, by virtue of the power vested in me by section 1 of the Companies (Winding-up) Act, 1890,[1] and all other powers enabling me in that behalf, order that a County Court which at the time of the coming into operation of the Companies (Winding-up) Act, 1890, is excluded from having jurisdiction in bankruptcy shall be excluded from having jurisdiction under the Companies (Winding-up) Act, 1890, until further order, and the district of any such County Court shall for the purposes of jurisdiction under the Companies (Winding-up) Act, 1890, be attached until further order to the Court to which that district is attached at the time of the coming into operation of this Act for the purposes of jurisdiction in bankruptcy.

II. GENERAL RULES AND REGULATIONS.

GENERAL RULES MADE PURSUANT TO SECTION 26 OF THE COMPANIES (WINDING-UP) ACT, 1890.[1]

Preliminary.

Short title and commencement.

1. These rules may be cited as "The Companies Winding Up Rules, 1890." They shall come into operation on the first day of January one thousand eight hundred and ninety-one.

Interpretation of terms.

2. In these rules, unless the context or subject matter otherwise requires,—

(a) "The Acts" means the Companies Acts, 1862 to 1890.[2]

"The Company" means a company which is being wound up, or against which proceedings to have it wound up have been commenced.

"The Court" includes a Judge of the Court, and a chief clerk of the Chancery Division of the High Court or other officer of the Court when exercising the powers of the Court pursuant to the Acts or these rules, or the practice of the Court.
