arrangement under the Bankruptcy Act, 1869,[1] pending at the commencement of the Bankruptcy Act, 1883, if at any time after the commencement of the last-mentioned Act there is no trustee acting in the liquidation by reason of death, or for any other cause, such of the Official Receivers of bankrupts' estates as is appointed by the Board of Trade for that purpose shall become and be the trustee in the liquidation, and the property of the liquidating debtor shall pass to and vest in him accordingly. And whereas by section 160 of the Bankruptcy Act, 1883, it is enacted, amongst other things, that, where a bankruptcy or liquidation by arrangement, under the Bankruptcy Act, 1869, has been or is hereafter closed, any property of the bankrupt or liquidating debtor which vested in the trustee and has not been realised or distributed, shall vest in such person as may be appointed by the Board of Trade for that purpose, and he shall thereupon proceed to get in, realise, and distribute the property in like manner, and with and subject to the like powers and obligations as far as applicable, as if the bankruptcy or liquidation were continuing, and he were acting as trustee thereunder: And whereas by section 161 of the Bankruptcy Act, 1883, it is enacted that in every bankruptcy under the Bankruptcy Act, 1869, pending at the commencement of the Bankruptcy Act, 1883, where a Registrar of the London Bankruptcy Court or of any County Court is or would hereafter but for the said enactment become the trustee under the bankruptcy, such of the Official Receivers of bankrupts' estates as may be appointed by the Board of Trade for that purpose, shall from and after the commencement of the Bankruptcy Act, 1883, be the trustee in place of the Registrar, and the property of the bankrupt shall pass to and vest in the Official Receiver accordingly:

And whereas by an Order of the Board of Trade dated the 1st day of January 1884,[2] Mr. Robert Palmer Harding (now Sir Robert Palmer Harding) was appointed as from the 1st of October then last, to be Chief Official Receiver and Official Receiver for the district of the High Court:

And whereas under and pursuant to Orders made by the Board of Trade from time to time under section 159 of the Bankruptcy Act, 1883, the said Sir Robert Palmer Harding as such Official Receiver as aforesaid became and is now trustee in certain liquidations by arrangement in the High Court under the Bankruptcy Act, 1869, which were pending at the commencement of the Bankruptcy Act, 1883:

And whereas under and pursuant to an Order of the Board of Trade dated the 1st day of January 1884,[3] made under the said section 160 of the Bankruptcy Act, 1883, whereby it was ordered that the Official Receiver attached to the Court having juris-
