The Fiji (Public Service) Order 1964

At the Court at Buckingham Palace the 26th day of March 1964

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers enabling Her in that behalf, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:—

Citation, publication and commencement

1. This Order may be cited as the Fiji (Public Service) Order 1964.

(2) This Order shall be published in the Gazette and shall come into operation on such day as the Governor, in his discretion, by Proclamation published in the Gazette shall appoint.

Interpretation.

2.(1) In this Order “ police officer " means any member of the Fiji Police Force.

(2) Unless the context otherwise requires, the provisions of section 2 of the Fiji (Constitution) Order in Council 1963(a)[1] shall apply for the purpose of interpreting this Order as they apply for the purpose of interpreting that Order.

(3) For the purposes of this Order a person shall not be considered to be a public officer by reason only of the fact that he—

(a) is the Chief Justice or any other judge of the Supreme Court;

(b) is a member of the Executive Council of the Colony;

(c) is a member of the Legislative Council of the Colony;

(d) holds the office of Speaker of the Legislative Council of the Colony;

(e) is a member of any Commission established by this Order;

(f) is on the retired list of any of Her Majesty's Armed Forces;

(g) is an officer or soldier of the Fiji Military Forces;

(h) is a member of the Special Constabulary; or

(i) is a teacher employed in pursuance of a scheme of co-operation with the Government of New Zealand.

Public officers.

3.(1) Subject to the provisions of this section, the appointment, promotion, transfer, termination of appointment, dismissal and disciplinary control of public officers is hereby vested in the Governor, in his discretion.

(2) (a) Subject to the provisions of paragraph (b) of this subsection, the Governor, in his discretion, may, by regulations published in the Gazette, provide for the delegation to any public officer, subject to such conditions as may be prescribed in any such regulations, of any of the powers vested in the Governor by subsection (1) of this section.

(b) The Governor shall not—

(i)delegate any such power unless he has obtained the consent of a Secretary of State to such delegation;
