The Government of the Republic of India and the Government of His Majesty the Sultan and Yang Di-Pertuan of Brunei Darussalam (hereinafter collectively referred to as the 'Participants' and individually referred to as the 'Participant');
TAKING NOTE of the Agreement between the Participants on Cooperation for the Establishment of Telemetry, Tracking and Telecommand Station for Satellites and Launch Vehicles and for Cooperation in the field of Space Research, Science and Applications signed on August 5, 1997 (hereinafter referred to as 'the 1997 mAgreement');
TAKING NOTE of the Memorandum of Understanding (MoU) between the Participants on Cooperation in the Operation of Telemetry, Tracking and Telecommand Station for Satellite and Launch Vehicles and for Cooperation in the field of Space Research, Science and Applications signed on May 22, 2008 (hereinafter referred to as 'the 2008 MoU');
RECOGNISING that under the 1997 Agreement and the 2008 MoU, the Government of India represented by Indian Space Research Organization (hereinafter referred to as 'ISRO') had established the Telemetry, Tracking and Command (TTC) station (hereinafter referred to as 'the ISRO TTC Station') for satellites and launch vehicles within the campus of the Submarine Cable Station, Tungku, of the Department of Telecommunications, Government of Brunei Darussalam;
NOTING that the Submarine Cable Station, Tungku has been transferred to Telekom Brunei Berhad (hereinafter referred to as 'TelBru') on the 1st April 2006 by virtue of the Telecommunication Successor Company Order, 2001;
TAKING NOTE of the support given by the Government of His Majesty the Sultan and Yang Di-Pertuan of Brunei Darussalam (hereinafter referred to as the 'Government of Brunei Darussalam') for the establishment of the ISRO TTC Station and its operation by ISRO;
NOTING that the Government of Brunei Darussalam has given the exclusive privilege for the operation and provision of telecommunication systems and services in Brunei Darussalam to the Authority for Info-communications Technology Industry of Brunei Darussalam (hereinafter referred to as 'AITI') by virtue of the Telecommunications Order, 2001;
BEARING IN MIND India's willingness to share its experience and expertise in space activities with other developing countries;
