ELY (BISHOP OF) v. BENTLEY [1732]
II BROWN.

remote from the said college; and that not any of the said Chaplains have at any time been called upon by you the said Dr. Bentley to reside there, or censured by you for such their non-residence. Et hoc fuit & est verum, etc. Et ut supra.

X. Item, We article and object to you, the said Dr. Richard Bentley, that by the eleventh of the said statutes it is ordained and provided, that there shall be a lecture read upon some part of the catechism, on every Sunday and holy-day, in the chapel of the said college, after the public sermon in the afternoon; and by such statutes, five or six of the Fellows ought to be appointed to perform that religious and important duty and from the time of making the said statutes, the names of the several Fellows appointed to read such lectures, have been entered in the book called the Conclusion Book, or some other book belonging to the college and that out of the number of those who had been so appointed, and gone through a course of such lectures, the college preachers ought to be chosen by the Master and eight senior Fellows, when and so often as any vacancy shall happen [224] among them; as by the said statutes, reference being thereunto had, will more fully appear. Et ut supra.

XI. Item, We article and object to you, the said Dr. Richard Bentley, that for twenty years past and upward you have not only neglected, but absolutely refused, though often called upon and required so to do, to appoint or fill up the prescribed number of Fellows to read the said lectures; so that the same have been frequently interrupted, neglected, and discontinued for many months, and sometimes for whole years together. Et objicimus & articulamur de quolibet alio temporis spatio, etc. Et ut supra.

XII. Item, We article and object to you, the said Dr. Richard Bentley, that more particularly, on or about the 22d day of April 1719, there being then several vacancies in the prescribed number of Fellows to read the said lectures, it was, at a public meeting of members of the said college that day held, proposed to you the said Dr. Bentley, by one of the senior Fellows then present, and the rest of the senior Fellows of the said college did then earnestly desire of you, that such vacancies might be supplied and filled up; and a list of several learned and worthy Fellows of the said college, well fit and qualified to read those lectures, particularly Mr. Malled, Mr. Craister, and others, were then offered to you the said Dr. Bentley, for that purpose; but that you the said Dr. Bentley absolutely refused to name or allow of, nor did you name or allow of any other person to perform that laudable and necessary exercise, but with great contempt and disdain told them, it was nonsense to talk of putting up five persons to catechise at the same time, or to that effect. Hocque, etc. Et objicimus & articulamur de quolibet atin tempore, etc. Et ut supra.

XIII. Item, We article and object to you, the said Dr. Richard Bentley, that soon after the premises in the next precedent article mentioned, the aforesaid Mr. Malled and Mr. Craister several times waited upon you, and earnestly desired and entreated you, that they might have leave to read the lectures upon the catechism, according to and in pursuance of the said statutes, in order to their being statutably capable of being elected college preachers; but you absolutely refused them, and turned them away from you with great rudeness and ill manners and the said Mr. Craister waiting upon you at another time with the like request, you the said Dr. Bentley refused him, and took him by the shoulders, and thrust him out of the doors. Hocque, etc. Et ut supra.

XIV. Item, We article and object to you, the said Dr. Richard Bentley, that when any vacancy hath happened among the college preachers, you the said Dr. Bentley have refused, though often called upon and required so to do, to call the eight senior Fellows together, within the time prescribed by the said eleventh statute of Queen Elizabeth; so that there have been very frequently several vacancies of college preachers at one time, and some years there were seven, and in other years there were nine places of college preachers vacant together, to the great prejudice and discouragement of such of the Fellows of the said college, as were capable of being, and ought to have been elected into such vacancies. Hocque, etc. Et objicimus & articulamur de quibuslibet aliis annis. Et ut supra.

XV. Item, We article and object to you, the said Dr. Richard Bentley, that by the 30th of the said statutes it is ordained and provided, that when any livings, in the gift and presentation of the college, shall become vacant, that the same shall, within one month after notice of such vacancy, without further delay, be conferred
