secondly, his cousin, Mary, only sister and h. of Charles, 6th Viscount Fairfax [I], da. of Nicholas Fairfax, by Mary, da, of Willian Weld abovenamed. She (by whom he had 9 children) d. 1 July 1741. He d. s.p.m.s.,([1]) at York, 20 Jan. 1772, when the Viscountcy became extinct. Admon. 6 March 1772 and again Nov. 1795.

FALCONER OF HALKERTOUN.

Barony [S]. I. 1647.

1.Sir Alexander Falconer, of Halkertoun, s. and b. of Sir Alexander F., of the same, by Agnes, sister of David, 1st Earl of Southsek [S.], da. of Sir David Carnegie, was b. about 1595 made one of the Lords of Session [S.], 9 July 1639, M.P. for co. Kincardine, 1613-47: Commissioner of the Treasury [S.], 16-15, and was cr. 20 Dec. 1647, LORD FALCONER OF HALKERTOUN [S.], with rem. to heirs male whatsoever.([2]) He was superseded as a Lord of Session, in 1649 for "malignacy," but restored in 1660. He m. Anne, only da. and h. of John (Lindasy), 8th Lord Lindsay of the Byres [S.], by Anne, da. of Lawrence Oliphant, Master of Oliphant. She, being then of legit. age, was served heir to her father, 17 April 1610. He d. 1 Oct. 1671.

II. 1671 2. Alexander (Falconer), Lord Falconer of Halkertoun [S.], only s. and h. He m. Margaret, 2d da. of James (Ogilvy), 2d Earl of Airlie [S.], by his first wife, Helen, da. of George (Ocilvy),1st Lord Banff [S]. He d. 4 March 1684.

III. 1681. 3. David (Falconer), Lord Falconer of Halkertoun [S.], s. and h. He was found of unsound mind 24 March 1710, and that he had been so for twenty years previously. He d. unm. Feb. 1724.

IV. 1724. 4. Alexander (Falconer), Lord Falconer of Halkertoun [S.], cousin and h. male, being s. and h. of Sir Alexander Falconer, Bart. [S.], of Glenfarquhar, who was s. and h. of Sir David F. of the same, which last named David was next br. to the first Lord. He suc. his father in the Baronetcy [cr. 20 March 1670/1], many years before he suc. his cousin in the Peerage. He d. s.p. 17 March 1727, when the Baronetcy [S.] became extinct.

V. 1727. 5. David (Falconer), Lord Falconer of Halkertoun [S.], cousin and h. male, being 1st surv. s. and h. of Sir David Falconer, of Newton, a Lord of Session [S.] under the style of "Lord Newton" by his second wife, Mary, da. of George Norvell, of Boghall, co. Linlithgow, which Sir David was 21 8. of Sir David F., of Glenfarquhar, abovementioned, the next br. to the first Lord. He was b. 1681 and was "a man of great honour, probity, and integrity."([3]) He m. (contract 27 Nov. 1703, the lady being 13 years old) at Keith Hall, Catharine Margaret, 1st da. of William (Keith), 2d Earl of Kintore [S.], by Catharine, da, of David (Murray), 4th Viscount Stormont [S.] He d. 24 Sep. 1751, in his 71st year at Inglismaldie. His widow, who was bap. at Keith Hall, 29 June 1690, d. at Edinburgh, 1 March 1762, in her 72d year.

  1. (a) Anne Fairfax, his only surv. child inherited his estates; she d. unm. 8 May 1793, when they passed to her cousin, Charles Gregory Pigott, afterwards Fairfax, s and h. of Nathaniel Pigott, the s. and b. of Ralph Pigott, by Alethea, only sister of the 9th and last Viscount.
  2. (b) The patent in the register is so much defaced, it can hardly be read, according to Hardie's MS., Advocates library." "There is a charter, to Alexander, Lord Falconer of Halkertoun, of the lands of Diracroft, co. Kincardine, dat, 24 June 1646, which would indicate that his creation took place at an earlier period" [than 20 Dec. 1617]. See Wood's "Douglas," vol. ii, p. 686 and vol. i, p. 56.
